AN EXPLORATORY ANALYSIS OF THE NEXUS BETWEEN CYBERCRIME AND NATIONAL SECURITY IN PAKISTAN: EVALUATING THE EXISTING LEGAL FRAMEWORK, INVESTIGATIVE CHALLENGES, AND PROPOSING A COMPREHENSIVE STRATEGY FOR EFFECTIVE CYBERCRIME PREVENTION AND PROSECUTION
Abstract
The exponential growth of cybercrime poses a critical threat to national security worldwide, and Pakistan is no exception. This research undertakes an exploratory analysis of the complex nexus between cybercrime and national security in Pakistan. It evaluates the existing legal framework, particularly the Prevention of Electronic Crimes Act, 2016 (PECA), and assesses its adequacy in addressing emerging cyber threats. The study identifies key investigative and prosecutorial challenges, including lack of technical expertise, institutional capacity gaps, jurisdictional limitations, and insufficient inter-agency coordination. By examining recent incidents and global best practices, this paper highlights the urgency of developing a robust, adaptive strategy to combat cyber threats. It proposes a multidimensional approach that includes strengthening legislation, investing in cyber forensic infrastructure, enhancing public-private partnerships, and fostering regional and international cooperation. The study also underscores the need for cyber awareness, specialized training for law enforcement, and judicial reforms to ensure timely justice. Ultimately, the research aims to contribute to a more secure cyber environment that can safeguard Pakistan's national interests in the digital age.
